Welcome to Celestia Jewel. These Terms and Conditions (“Terms”, “Agreement”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“Buyer”, “User”, “you”), and Şükrü Özel Gözdemir (Celestia Jewel) (“Company”, “Seller”, “we”, “us”, “our”), concerning your access to and use of our website and purchase of our products.

By accessing the site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

1. Legal Framework and Compliance

This Agreement is governed by and construed in accordance with both national and international digital commerce and consumer protection laws, including but not limited to:

  • Turkish Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.
  • Turkish Personal Data Protection Law No. 6698 (KVKK).
  • The European Union (EU) Consumer Rights Directive (2011/83/EU) and E-Commerce Directive.
  • United Kingdom Consumer Rights Act 2015.
  • United States Uniform Commercial Code (UCC) regarding the sale of goods where applicable.

2. Eligibility and Account Security

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You are entirely responsible for maintaining the confidentiality of your account credentials.

3. Product Information, Pricing, and Corrections

We make every effort to display as accurately as possible the colors, dimensions, and images of our natural stones and jewelry. However, since we use raw natural stones, slight variations in texture, color, and size are inherent characteristics of the product and do not constitute a defect.

Prices for our products are subject to change without notice. In accordance with international trade standards, we reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice.

4. Ordering and Formation of Contract

The technical steps leading to the formation of the contract between you and Celestia Jewel are as follows: You select your products, place them in your cart, enter your shipping/billing details, and confirm the transaction. The contract becomes binding and effective immediately upon our electronic receipt and confirmation of your payment.

5. International Shipping, Customs, and Import Duties

In accordance with international shipping laws and the Incoterms rules for consumer delivery:

  • The Buyer is strictly designated as the Importer of Record.
  • All international packages may be subject to import duties, customs clearance fees, and local taxes (VAT/GST) levied by the destination country’s government. These costs are completely independent of Celestia Jewel and are the **sole responsibility of the Buyer**.
  • Refusal to pay customs duties resulting in the return or abandonment of the product will entitle the Seller to deduct all associated shipping, return shipping, and administrative penalty costs from the Buyer’s potential refund.

6. Right of Withdrawal and Returns

Pursuant to Distance Contracts Regulations and EU/UK statutory cooling-off periods:

  • The Buyer has a legal right to withdraw from standard purchases within 14 days (or 7 days as designated in our specific local return windows) without giving any reason.
  • Exceptions: In accordance with international exclusions on consumer cancellation rights, **customized, bespoke, engraved, or modified items** are strictly exempt from the right of withdrawal and cannot be returned or exchanged unless they suffer from a manufacturing defect caused by the Seller.

7. Intellectual Property Rights

Unless otherwise indicated, the Site, including its source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics, as well as the “CELESTIA JEWEL” logo and trademarks, are owned or controlled by us and are protected by international copyright, trademark, and intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Celestia Jewel, its directors, or employees shall not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the site or products purchased. Our total liability to you for any claim arising out of or relating to these terms shall not exceed the total amount paid by you for the specific product in question.

9. Severability and Entire Agreement

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable under applicable national or international statutes, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

10. Governing Law and Jurisdiction

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with Turkish Law. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the Consumer Arbitration Committees and Consumer Courts in the jurisdiction of the Seller’s registered location, or as mandated by mandatory international consumer protection provisions (such as the Buyer’s local habitual residence courts if strictly protected under EU law).
